Καταθέτω εδώ τους ναυτιλιακούς όρους επειδή εύκολα μπορεί να τους μπερδέψει κανείς.

Εκτός ναύλωσης (off-hire). Ο χρόνος, ο οποίος συνήθως μετράται σε ημέρες, στη διάρκεια του οποίου υπάρχει αναστολή πληρωμών ναύλων λόγω μη διαθεσιμότητας του πλοίου για να πραγματοποιήσει εμπορική διαδικασία, π.χ. λόγω βλάβης ή προγραμματισμένης συντήρησης.

Το off charter (συνήθως στα come off charter / go off charter) χρησιμοποιείται όταν ολοκληρώνεται η ναύλωση. Το off hire χρησιμοποιείται όταν διακόπτεται προσωρινά η ναύλωση.

(Σε επίπεδο γραμματικής, ας σημειωθεί ότι η χρήση σε θέση επιρρήματος ή κατηγορουμένου δεν θέλει ενωτικό, η χρήση σε θέση επιθέτου θέλει ενωτικό, π.χ. came off charter, was off hire, an off-hire clause.)

OFF-CHARTER. The termination of a vessel charter agreement, freeing the vessel to pursue other cargoes. Off-charter should not be confused with off-hire, in which the payment of hire is suspended for some reason, but the contract remains in force.

OFF-HIRE. A period of time when a chartered vessel is not earning income for the owner. Most charter parties provide for times when a vessel will be considered off-hire, e.g., when the vessel fails to perform properly.

OFF-HIRE CLAUSE. Also known as the breakdown clause, a provision in a time charter party that charter hire shall cease from the breakdown or inability of the vessel to perform until the condition is remedied. A common breakdown clause provides that hire shall abate as the result of “any detention of or loss of time due to deficiency of men or stores, fire, breakdown of or damage to hull, machinery or equipment, grounding, dry- docking, cleaning of boilers, fumigation (including deratization and extermination of vermin) and guarantee unless occasioned by the nature of the cargo carried or ports visited ... or to any cause whatsoever rendering the vessel inefficient for duties.”
In some charter parties, hire continues for a specified period, usually forty-eight hours, following breakdown.

Off hire. In a time charter the charterer has the obligation to pay hire for the Ship continuously during the charter period at the agreed rate.
The hire is paid for the use (and hire) of the vessel. Therefore if the Charterer is prevented from making the full use of the ship for specific, agreed reasons which are completely within the control of the shipowner-he would not be responsible to pay hire for the period dosing which the ship is not at his full disposition, that is, during which there is loss of time to the Charterer. This period is known as "off hire". If there is loss of time for reasons which are not within the owner's control, for example, because of strikes by shore labour or because of bad weather, the ship is not "off hire" and the hire continues to be payable.
Certain agreed events can cause the ship to become off-hire. These are generally related to the equipment breaking down, the deficiency of the crew, and other similar causes. Such events are known as "off hire events". The ship can also be treated as being "off hire" if its performance is not as described in the charterparty, e.g., if it cannot meet the warranted speed and there is an overall loss of time on sea passages because of the slower speed. In some charters the ship becomes off-hire when the shipowner decides to put the ship into drydock during the charter period and also if there is any time lost because the vessel fails to comply with anti-pollution regulations.

Σε ορισμένες σαφώς καθορισμένες περιστάσεις ένα σκάφος που δεσμεύεται κάτω από ένα ναυλοσύμφωνο μπορεί να είναι Off-hire (εκτός ναύλου). Ίσως περισσότερο από οποιαδήποτε άλλη ρήτρα σε ένα ναυλοσύμφωνο η ακριβής λεκτική διατύπωσή του όρου είναι πολύ σημαντική επειδή μόνο από την αναφορά σ’ αυτή, μπορεί να καθοριστεί εάν έχει υπάρξει ένα περιστατικό Off-hire, δηλ. ένα γεγονός που έχει στερήσει τη χρήση του σκάφους από τον ναυλωτή ώστε να του δίνει το δικαίωμα να το χαρακτηρίσει Off-hire. Ο βασικός κανόνας της ερμηνείας είναι ότι η αιτία της καθυστέρησης πρέπει να συνδέεται με την αποδοτικότητα του σκάφους και να αποτρέπει την πλήρη λειτουργία του. Αυτό θα μπορούσε να λάβει ποικίλες ερμηνείες, η προφανέστερη των οποίων είναι η φυσική ζημία στο σκάφος.
